GENERAL PROVISIONS The online store www.coolfitness.eu operates under the terms specified in these Terms and Conditions. These Terms and Conditions define the conditions for concluding and terminating Sales Agreements, the complaint procedure, and the types and scope of services provided electronically by the store www.coolfitness.eu, the rules for providing these services, the conditions for concluding and terminating contracts for the provision of electronic services. Every Service Recipient, upon undertaking activities aimed at using the Electronic Services of the store www.coolfitness.eu, is obliged to comply with the provisions of these Terms and Conditions. In matters not regulated by these Terms and Conditions, the provisions of the following laws shall apply:
the Act on the provision of electronic services of July 18, 2002,
the Consumer Rights Act of May 30, 2014,
the Act on out-of-court resolution of consumer disputes of September 23, 2016,
the Civil Code Act of April 23, 1964, and other relevant provisions of Polish law.
DEFINITIONS ORDER FORM – a form available on the website www.coolfitness.eu enabling the placement of an Order. CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller. CONSUMER – a natural person who performs a legal act with an entrepreneur not directly related to their business or professional activity. ENTREPRENEUR – a natural person, legal person, and an organizational unit without legal personality, which the law grants legal capacity, conducting business or professional activity on their own behalf. PRODUCT – a movable item available in the Store that is the subject of a Sales Agreement between the Customer and the Seller. TERMS AND CONDITIONS – these Terms and Conditions of the Store. STORE – the online store of the Service Provider operating at www.coolfitness.eu. SELLER, SERVICE PROVIDER – Konrad Wiśniewski FITDOG, Wolności 21, 59-830 Olszyna, Poland, NIP: 6131579156. SALES AGREEMENT – a sales agreement for the Product concluded between the Customer and the Seller via the Store. ORDER – a declaration of will by the Customer constituting an offer to conclude a Sales Agreement for the Product with the Seller. PRICE – the value expressed in monetary units that the Customer is obliged to pay the Seller for the Product.
PRODUCT INFORMATION AND ORDERING The store www.coolfitness.eu sells Products via the Internet. The Products offered in the Store are new, compliant with the contract, and have been legally introduced to the European market. The information provided on the Store’s website does not constitute an offer within the meaning of the law. By placing an Order, the Customer submits an offer to purchase a specific Product under the conditions specified in its description. The Product price displayed on the Store’s website is in euros (EUR) and includes all components. The price does not include delivery costs. Orders can be placed via the website using the Order Form (Store www.coolfitness.eu) – 24 hours a day, all year round. A condition for placing an Order in the Store by the Customer is to read and accept the Terms and Conditions during the Order placement.
SALES AGREEMENT CONCLUSION To conclude a Sales Agreement, the prior submission of an Order by the Customer using the method provided by the Seller, in accordance with § 3 points 5 and 6 of the Terms and Conditions, is necessary. After placing an Order, the Seller immediately confirms its receipt. The Order receipt confirmation results in the Customer being bound by their Order. The receipt confirmation is sent via email. The Order receipt confirmation contains:
confirmation of all significant Order elements,
a withdrawal form,
these Terms and Conditions containing information about the right to withdraw from the agreement. Upon receipt of the email, the Sales Agreement is concluded between the Customer and the Seller. Each Sales Agreement will be confirmed by a proof of purchase attached to the Product.
PAYMENT METHODS The Seller provides the following payment methods:
credit card payment,
PayPal. The Customer is obliged to make payment within 30 business days from the date of the Sales Agreement conclusion unless otherwise stated. The Product will be shipped only after payment is made.
SHIPPING COSTS, DELIVERY TIME, AND METHODS The shipping cost for the Product, borne by the Customer, is determined during the Order process. The delivery time consists of product preparation and delivery time:
product preparation takes up to 14 business days,
delivery within 4-5 business days. Products are shipped to Germany, Belgium, France, Spain, the Netherlands, Luxembourg, Portugal, and Italy via InPost to parcel lockers, and to Germany additionally via DHL courier. The shipping cost is 5.90 EUR.
RETURNS The return cost is borne by the Customer. Warranties may be provided in English.
COMPLAINT PROCEDURE The Seller is responsible to the Consumer for the lack of conformity of the Product with the contract within 2 years from the date of delivery. Complaints can be submitted via email to returns@coolfitness.eu or in writing to Konrad Wiśniewski, Wolności 21, 59-830 Olszyna, Poland. The Seller shall respond to the complaint within 14 days.
